Terms of Service

Out Bid, Out Rank ("the Service") is an advertising directory. Users ("Listers") publish a short pitch, skills, and links, and pay bids to determine the order in which listings are displayed on our leaderboards. Visibility is determined solely by cumulative paid bids over a 24-hour window, a rolling 30-day window, and all time. Ties are broken in favour of the most recent successful bid.

By using the Service you agree to these Terms. If you do not agree, do not use the Service.

A bid is a payment for advertising placement. It is not a deposit, escrow, wager, investment, or purchase of goods or services from other users. Bids are priced in US dollars. The minimum bid or top-up is US$5. Bids apply only to the specific listing selected at checkout.

Rankings change as others bid. Paying a bid does not guarantee any particular position, duration of visibility, engagement, or work outcome. Bids are non-refundable once processed, except where a refund is required by law, including the Australian Consumer Law.

Accounts are created by verifying an email address with a one-time code. You are responsible for maintaining control of your email account and for all activity under your account. You must be at least 18 years old and able to form a binding contract.

You retain ownership of the content you submit (pitch, skills, details, and links) and grant Khop Media Pty Ltd a worldwide, non-exclusive, royalty-free licence to host, display, and promote it as part of the Service.

You must not submit content or links that are unlawful, misleading, defamatory, infringing, obscene, malicious (including malware or phishing), or that impersonate another person. We may remove content or suspend accounts that breach these Terms at our discretion, without refunding associated bids where the breach is deliberate or serious.

The Service only displays listings. Any engagement, contract, or payment between a visitor and a Lister happens entirely outside the Service and at the parties' own risk. We do not vet, endorse, or guarantee any Lister, their skills, or their links.

Payments are processed by Stripe. We do not store your card details. You authorise the charge at checkout for the bid amount you enter. Amounts are in US dollars; your bank may apply currency conversion and fees.

We may modify, suspend, or discontinue the Service (or any leaderboard mechanic) at any time. We will make reasonable efforts to honour visibility already paid for or, at our option, provide a pro-rata credit. We may update these Terms; continued use after changes take effect constitutes acceptance.

To the maximum extent permitted by law, and subject to guarantees that cannot be excluded under the Australian Consumer Law, Khop Media Pty Ltd is not liable for indirect or consequential loss, loss of profit, or loss of opportunity arising from the Service. Where liability cannot be excluded, it is limited to resupplying the Service or the amount you paid in the 3 months before the claim.

These Terms are governed by the laws of Australia. Disputes are subject to the non-exclusive jurisdiction of the Australian courts.
